PERSONAL DATA PROCESSING AND PROTECTION POLICY – ESTACIÓN DENTAL S.A.S.

In compliance with the provisions of the Political Constitution of Colombia, Law 1581 of 2012, Decree 1377 of 2013, Single Decree 1074 of 2015, and all other regulations governing the protection of personal data in Colombia, ESTACIÓN DENTAL S.A.S., as the Personal Data Controller, hereby adopts this Personal Data Processing and Protection Policy. The purpose of this policy is to guarantee the constitutional right of all individuals to know, update, rectify, and delete information collected about them in databases or files.

1. IDENTIFICATION OF THE DATA CONTROLLER

ESTACIÓN DENTAL S.A.S. is responsible for the collection, storage, use, circulation, updating, deletion, and, in general, the processing of personal data belonging to patients, clients, suppliers, employees, and any other data subjects.

2. DEFINITIONS

For the purposes of this policy, the definitions established in Law 1581 of 2012 shall apply:

  • Personal Data: Any information linked or that can be associated with one or more specific or identifiable natural persons.

  • Data Subject: The natural person whose personal data is subject to processing.

  • Processing: Any operation or set of operations performed on personal data, such as collection, storage, use, circulation, or deletion.

  • Authorization: The prior, express, and informed consent of the data subject to carry out the processing of personal data.

  • Database: An organized set of personal data that is subject to processing.

3. GUIDING PRINCIPLES FOR PERSONAL DATA PROCESSING

ESTACIÓN DENTAL S.A.S. shall comprehensively apply the principles established under Colombian legislation:

  • Legality: Data processing shall be subject to the applicable legal provisions.

  • Purpose: Data shall be processed for legitimate, specific, explicit purposes that are communicated to the data subject.

  • Freedom: Processing may only be carried out with the prior, express, and informed authorization of the data subject, unless a legal exception applies.

  • Truthfulness or Quality: Information must be truthful, complete, accurate, updated, and verifiable.

  • Transparency: The data subject's right to obtain information regarding their data shall be guaranteed.

  • Restricted Access and Circulation: Processing shall be subject to limits derived from the nature of the data.

  • Security: Necessary technical, human, and administrative measures shall be implemented to protect the data.

  • Confidentiality: All persons involved in the processing are required to guarantee the confidentiality of the information.

4. COLLECTED PERSONAL DATA

ESTACIÓN DENTAL S.A.S. may collect and process, among others, the following data:

  • Full name

  • Identification number

  • Date of birth

  • Residential address

  • Telephone number

  • Email address

  • Emergency contact information

  • Financial information for billing and payments

  • Medical history and oral health-related information, in accordance with the legal provisions applicable to the healthcare sector.

5. PURPOSES OF THE PROCESSING

Personal data will be used for the following purposes:

  • Provision of general and specialized dental services.

  • Management of medical records in compliance with healthcare sector regulations.

  • Scheduling, confirmation, modification, or cancellation of appointments.

  • Billing, collection, and administrative management.

  • Handling of inquiries, requests, petitions, complaints, and claims.

  • Contact for sending reminders, prevention campaigns, promotions, or institutional information.

  • Management of contractual relationships with suppliers and employees.

  • Compliance with legal, regulatory, tax, and healthcare obligations.

6. AUTHORIZATION OF THE DATA SUBJECT

The collection, storage, use, and circulation of personal data by ESTACIÓN DENTAL S.A.S. requires the free, prior, express, and informed consent of the data subject, except in cases expressly authorized by law.

Such authorization may be obtained through physical, electronic, digital, or telephone means, or through unambiguous conduct by the data subject that allows for a reasonable conclusion that consent was granted.

7. RIGHTS OF THE DATA SUBJECTS

As a data subject of your personal data, you have the right to:

  • Know, update, and rectify your personal data.

  • Request proof of the authorization granted.

  • Be informed regarding the use given to your personal data.

  • Submit inquiries and claims.

  • Revoke the authorization granted when there is no legal or contractual duty that prevents it.

  • Request the deletion of your personal data when applicable.

  • Access your personal data free of charge.

8. PROCEDURE FOR INQUIRIES, CLAIMS, REVOCATION, AND DELETION

Data subjects may submit inquiries, claims, updates, corrections, revocations of authorization, or requests for deletion of their personal data via email at: estaciondental@hotmail.com

When an individual wishes ESTACIÓN DENTAL S.A.S. to remove their personal data from its databases, they may request it by written communication sent to the aforementioned email. The request will be processed in accordance with current legal terms, provided that there is no legal or contractual obligation that requires the information to remain.

Applicable Legal Terms:

  • Inquiries: Maximum of ten (10) business days.

  • Claims: Maximum of fifteen (15) business days.

9. SENSITIVE DATA AND DATA OF MINORS

ESTACIÓN DENTAL S.A.S. may process sensitive data, including health-related information, only when necessary for the proper provision of dental services and in accordance with the law.

In the case of minors, the processing will be carried out respecting their best interests and with the authorization of their legal representative when required.

10. SECURITY MEASURES

ESTACIÓN DENTAL S.A.S. implements reasonable administrative, technical, and human security measures to protect personal information against alteration, loss, consultation, unauthorized or fraudulent use, or access.

11. VALIDITY OF THE DATABASES

Personal data will remain stored only for the time necessary to fulfill the purposes for which it was collected and to comply with legal or contractual obligations, especially those related to medical records and regulations of the healthcare sector.

12. AMENDMENTS TO THE POLICY

ESTACIÓN DENTAL S.A.S. reserves the right to modify this Personal Data Processing Policy at any time. Any substantial change will be informed in a timely manner through its official channels.

13. EFFECTIVE DATE

This Personal Data Processing and Protection Policy is effective as of its publication on the official website of ESTACIÓN DENTAL S.A.S. and will remain in effect for as long as the company carries out the processing of personal data.
